STATE LAW GUIDE

Sued After the Statute Expired in Oklahoma?

The Oklahoma rule, with the statute it comes from.

You are not the only one. Hundreds of thousands of these get filed every year, mostly against ordinary people who hit a bad stretch. Life gets messy. None of it makes you a bad person. It just makes you human.

They file these by the thousand. You are doing this once. That gap is the only real advantage they have, and it closes the moment you know what they have to prove. Learn it, use it, fight back strong.

The short answer

Plead it, in your answer, within your deadline. An expired limitation period is an affirmative defense in Oklahoma, which means it only exists in your case if you put it there. See 12 O.S. 2008(C).

And separately, the filing may itself be prohibited conduct.

Step one: fix the dates before you argue about them

Before anything, establish two dates from your own credit reports:

Then measure against the period: five years on a written contract, three on an agreement not in writing. See 12 O.S. 95(A)(1) and 12 O.S. 95(A)(2).

Do this first because the argument is only as good as the date, and because the plaintiff will produce its own version of the account history.

Step two: plead it, on time

File your answer within twenty days of service on the civil docket, unless the plaintiff elected thirty-five. See 12 O.S. 2012(A). The day of service does not count and the last day extends if the clerk's office is closed. See 12 O.S. 2006(A).

State the limitation defense affirmatively. See 12 O.S. 2008(C). A court does not apply it for you, and a default judgment is entered without anyone looking at a date.

While you are there, you may also deny what you have not been shown: a statement that you lack knowledge sufficient to form a belief has the effect of a denial. See 12 O.S. 2008(B).

Step three: the conduct point

A debt collector must not bring or threaten to bring a legal action against a consumer to collect a time-barred debt. See 12 C.F.R. 1006.26(b).

That is a rule about their behaviour, not only a defense to their claim. If the case really is out of time, that is worth raising with legal aid or a consumer attorney, because some lawyers take matters of that kind on a basis that does not require a fee from you.

Do not accidentally restart it while responding

Everything about this defense turns on dates, so protect them:

Any of those may be treated as acknowledging the debt and can restart the period. The defense you were about to rely on can be given away in a ten minute phone call.

If a judgment has already been entered

There is still a route, and the timing is strict.

When What is available
Within 30 days of the judgment being filed The court may correct, open, modify or vacate on motion. See 12 O.S. 1031.1(B)
Within 2 years Grounds in paragraphs 4, 5 and 7 of 12 O.S. 1031
Within 3 years Grounds in paragraphs 3 and 6
No limit A judgment that is void

See 12 O.S. 1038. The listed grounds in 12 O.S. 1031 include a defendant having no actual notice of the action at the time the judgment was filed.

Inside thirty days is the cheapest this will ever be. Call legal aid or a lawyer the same day.

The honest framing

An expired limitation period does not make a lawsuit disappear by itself. It is a defense, which means it is an argument somebody has to make, in writing, on time.

That is good news rather than bad: it is entirely within your control, and it costs nothing to file. The fee schedule lists no charge for filing an answer. See 28 O.S. 152.1(A)(2).
