CREDITOR-SPECIFIC DEFENSE GUIDE

LVNV Funding: Will they dismiss the case if I settle?

Here is exactly what to do right now.

You are not the only one. Hundreds of thousands of these get filed every year, mostly against ordinary people who hit a bad stretch. Life gets messy. None of it makes you a bad person. It just makes you human.

They file these by the thousand. You are doing this once. That gap is the only real advantage they have, and it closes the moment you know what they have to prove. Learn it, use it, fight back strong.

The short answer

Only if the agreement says so, and for this plaintiff you also need to check which company is promising it. A settlement signed only by the servicer is not the plaintiff agreeing to end the lawsuit.

The ordinary gap

A settlement is a contract. If it promises money and says nothing about the case, you have promised payment and received no promise about the lawsuit.

In practice a dismissal usually follows payment. What you want is for that to be an obligation rather than a custom, because an obligation is enforceable and a custom is a habit.

The sentence to insist on: upon receipt of the final payment, the plaintiff will file a dismissal of the case with prejudice, within a stated number of days.

The part specific to LVNV

The plaintiff is LVNV Funding. The negotiation is usually with Resurgent Capital Services or with the law firm handling the file.

So read the signature block and the defined terms. The document should make clear that LVNV Funding, the party that actually filed the case, is bound to dismiss it. An agreement in which only the servicer promises to cease collection activity leaves the lawsuit sitting where it is.

This is not a trap anyone is necessarily setting. It is a drafting question that arises whenever the entity you are talking to is not the entity suing you, and it is cheap to get right before signing and expensive afterwards.

With prejudice and without

Term Meaning
With prejudice The claim is over and cannot be brought again
Without prejudice Closed for now, and can be refiled

Paying for a dismissal without prejudice buys less than it appears to, especially on a debt that could be sold on again.

Everything that belongs in the writing

The structure worth recognising

Some offers are a consent or agreed judgment with a payment plan: the judgment is entered now and held while you pay. Miss one payment and the full original amount becomes immediately enforceable.

That is not a settlement that ends a case. It is a judgment with a grace period. Recognise it before signing.

After it is done

Keep the dismissal order, the agreement and the proof of payment together. Debts get sold, resold and occasionally refiled by someone who does not know the history, and your file is what ends that conversation in one email.

Then pull your credit reports about sixty days later and check the account reports the way the agreement said it would. That step is the one almost everybody skips.
