Can They Freeze My Bank Account in Oklahoma?
The Oklahoma rule, with the statute it comes from.
You are not the only one. Hundreds of thousands of these get filed every year, mostly against ordinary people who hit a bad stretch. Life gets messy. None of it makes you a bad person. It just makes you human.
They file these by the thousand. You are doing this once. That gap is the only real advantage they have, and it closes the moment you know what they have to prove. Learn it, use it, fight back strong.
The short answer
Not without a judgment. After one, a bank account can be garnished, but Social Security money cannot be taken at all, and your bank is required to protect two months of directly deposited benefits automatically.
Social Security is protected outright
None of the moneys paid or payable under the Social Security subchapter is subject to execution, levy, attachment, garnishment, or other legal process. See 42 U.S.C. 407(a).
That is federal and it is categorical.
And your bank must act on it without being asked
This is the part almost nobody knows.
When a garnishment order arrives, the financial institution performs an account review. If that review shows a benefit agency deposited a benefit payment during the two month lookback period, the institution must immediately calculate a protected amount and give the account holder full access to it. See 31 C.F.R. 212.6.
So if your benefits are direct deposited, two months of them should be left available to you automatically, before you say anything.
Should is not the same as always. Mistakes happen, and an account can be frozen in error. Which is why the next section matters.
You get a notice, and you have five days
A postjudgment garnishment summons carries a notice of garnishment and exemptions and an application for you to request a hearing, and it must be mailed to you. See 12 O.S. 1172.2(A).
The notice tells you that you may claim an exemption for assistance received under the Federal or Oklahoma Social Security Act, among other exemptions. File the claim within five days of receiving it and the court must set a hearing within ten days. See 12 O.S. 1174(C).
Five days. Open that envelope the day it arrives, and do not wait to see whether the problem resolves itself.
Other exempt property
Oklahoma exempts from attachment, execution and forced sale a list that includes your principal residence, household and kitchen furniture, wearing apparel up to $4,000, one motor vehicle up to $7,500, and further categories set out in the statute. See 31 O.S. 1(A).
Wages are separately protected at seventy-five percent of earnings for the last ninety days. See 31 O.S. 1(A)(18).
If you support dependents
After a garnishment issues, a debtor who supports a family or other dependents may apply for a hearing to exempt, by reason of undue hardship, the portion of earnings necessary for their maintenance. See 31 O.S. 1.1.
A practical warning about mixed accounts
The automatic protection in 31 C.F.R. 212.6 works off benefit payments deposited by a benefit agency during the lookback period. An account holding benefits mixed with other money is harder for a bank to assess quickly, and is exactly the situation where a wrongly frozen account happens.
If that is your situation, the notice and the five day hearing request are your mechanism, and legal aid is worth calling the same day.
The upstream point
All of this is what happens after a judgment. The step that avoids it is answering within twenty days of being served. See 12 O.S. 2012(A).
